1. Interpretation

1.1 Definitions
Unless otherwise stated, the following definitions apply to this document:
- "company", "we", "us", and "our" are references to ALadder;
- "you", "your" and "customer" are references to the person paying for services ALadder from or using the ALadder website and related services, having entered into this agreement.

The words "include" and "including" are to be construed without limitation.

1.3 Headings
The headings in this document are for convenience only and shall not affect the interpretation of these conditions.

2. General

ALadder and its affiliates provide their services to you subject to the following conditions, unless otherwise expressly agreed in writing by the Owners of the Company. Only the Owners of the Company have authority to vary or omit any of these terms and conditions.
The jurisdiction and law applicable to this contract shall be that of England and Wales.
If you visit or shop at ALadder, you accept these conditions. Please read them carefully. In addition, when you use any current or future ALadder service or visit or purchase from any business affiliated with ALadder, whether or not included in the ALadder Website, you also will be subject to the guidelines and conditions applicable to such service or business.

3. Use of data

ALadder complies with UK Data Protection Law. Information will not be passed to any third party without your expressed permission. Only carriage details will be given to a third party.

3.1 Automatic Information
In common with many commercial organizations we monitor the use of this website by collecting statistical user information. No personally identifiable data are collected in this process.

3.2. Electronic Communications
By contacting or purchasing from ALadder you consent to us communicating with you for the purpose of satisfying your request. This may include by email, telephone and/or post.

4. Products

4.1 Product Descriptions
ALadder and its affiliates attempt to be as accurate as possible. However, ALadder does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by ALadder itself is not as described, your sole remedy is to return it in unused condition.

4.2 Stock Levels
Our products are offered subject to availability. If for any reason we cannot supply you with any part of your order we will contact you via email or phone to advise you. We may need to cancel or refund the item from your order, in which case the funds will be paid directly back into your account.

5. Payment

Prices shown are inclusive of VAT and carriage where applicable. Export orders can be charged without VAT, but may incur an additional carriage charge. If an additional carriage charge is due we will contact you to confirm before processing your order.
The price of the Goods shall be paid in sterling in the UK.
Prices are subject to change without notice.

5.1 Is the transaction secure?
Credit card processing is facilitated securely by a choice of Stripe or PayPal. At no point does ALadder receive your credit card details.

6. Delivery of products

ALadder will use all reasonable endeavors to deliver at the time stated, but delivery dates given are estimates only. The Company shall not be liable for any delay occasioned by any cause whatsoever beyond the Company's reasonable control.

The Buyer shall inspect the Goods upon delivery.

We will make every reasonable effort to ensure that your goods arrive on time, however we shall not be held liable for any consequential losses, damages or expenses incurred by you the purchaser or any third party arising directly or indirectly out of late or non delivery of the order or any part thereof. If in the event of goods damaged in transit please ensure that you sign 'goods damaged'.
ALadder will make good at its option by repair or replacement any defects in the Goods due solely to defective workmanship or materials.

If items are to be sent abroad or off UK Mainland ALadder will provide a quotation of this cost at the time of confirming your order.

If your paying through Pay Pal please include your contact phone number in the speical instructions for the carrier.

6.1 Risk of Loss
All items purchased from ALadder are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier.

7. Exchange and Returns Policy

Goods may be returned to us unused and in perfect condition within 14 days of dispatch for exchange or refund. Any shortage of Products or any visible damage must be marked on the carrier's delivery note.
If you receive a defective product, please contact us to arrange an exchange or refund. We aim to replace any defective items with replacements. If this is not possible we shall refund you immediately. Exchanged items will only be sent after we have received the defective item back from you in its original packaging.
Please contact us for more information before returning items.

7.1 Damages must be reported within 48 hours of receipt of delivery - ideally we would like any damages noted at the time of delivery when signed for, or for the delivery to be refused (this will enable us to claim on our carriers).

7.2 Unwanted Items - If a customer changes their mind we will collect and credit less 25% of the value of the goods and a collection fee applies (Werner £20.00 and Fakro £40.00. It is your responsibility to ensure that you check platform height, overall height and weight before placing your order.

8. Copyright

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of ALadder or its respective original owners and is protected by United Kingdom and international copyright laws. The compilation of all content on this site is the exclusive property of ALadder and protected by UK and international copyright laws.

9. Other Businesses

Parties other than ALadder subsidiaries operate stores, provide services, or sell product lines on this site. In addition, we provide links to the sites of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, and we do not warrant the offerings of any of these businesses or individuals or the content of their Websites. We do not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analysing data, providing marketing assistance, processing credit card payments, and providing customer service. They have access to personal information needed to perform their functions, but may not use it for other purposes.

10. Conditions of Use, Notices and Revisions

If you choose to visit ALadder your visit and any dispute over privacy is subject to this Notice and our Conditions of Use, including limitations on damages, arbitration of disputes, and application of the law of the state. Our business changes constantly. This Notice and the Conditions of Use will change also, and use of information that we gather now is subject to the Privacy Notice in effect at the time of use. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our Website frequently to see recent changes.

11. Disclaimer of Warranties and Limitations of Liability

This site is provided by ALadder on an "AS IS" and "AS AVAILABLE" basis. ALadder makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk.

To the full extent permissible by applicable law, ALadder disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. ALadder does not warrant that this site, its servers, or E-mail sent from ALadder are free of viruses or other harmful components. ALadder will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive and consequential damages.
